Mills SP-02-66 2 <br /> Board of Appeals <br /> SPECIAL PERMIT CRITERIA <br /> § 174-25.A.8 of the Zoning By-laws states: <br /> "Conversion of an existing dwelling to accommodate not more than two (2) families, <br /> I <br /> provided that there is not external evidence of occupancy by more than one (1) family, <br /> and further provided that each dwelling unit resulting from such conversion shall have 'III <br /> � Ili <br /> not less than seven hundred fifty (750) square feet of habitable floor space". L!i' <br /> GENERAL FINDINGS <br /> I <br /> �I <br /> 1. that the subject property is located at 5 Wilann Road and consists of 0.52 <br /> acres of land. <br /> SPECIFIC FINDINGS <br /> The Board determined to allow: I! II <br /> 1. conversion of an existing dwelling to accommodate not more than two (2) L L <br /> families, provided that there is not external evidence of occupancy by more I I( l <br /> than one (1) family, <br /> 2. and further provided that each dwelling unit resulting from such conversion <br /> shall have not less than seven hundred fifty (750) square feet of habitable j <br /> floor space. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on May 22, <br /> 2002 to grant a Special Permit to allow for an in-law apartment on the second level of an <br /> existing dwelling on property located at 5 Wilann Road. The Special Permit is <br /> conditioned upon compliance with the following: F <br /> SII <br /> 1. submitted plans. <br /> 2. before a building permit will be issued,the Petitioner must provide evidence <br /> that payment of all taxes on the property located at 5 Wilann Road has been <br /> made. <br /> I' <br /> i <br />
