Continued from 4/24/02 and 5/22/02 to allow for Conservation <br /> Commission approval. <br /> Sitting: Edward M. Govoni, James E. Regan III and Robert G. Nelson. <br /> I ; <br /> it <br /> Mr. Michael H. Grotzke of The Phoenix Group represented the Petition and submitted <br /> plans with final revision sion date of 6/1 /02 <br /> . Mr. Grotzke stated that plans call for <br /> construction of a Section 10 float, pier and ramp on Jehu Pond. There is no need for a <br /> Variance from the setback requirements. II <br /> I <br /> The Conservation Commission has approved the proposal. <br /> No comments were received from abutters. <br /> Mr. Nelson moved to grant a Special Permit, subject to criteria/findings 1, 2, 3, 4, 5 and <br /> The Phoenix Group plan entitled `Glass Residence, 133 Tide Run, New Seabury, MA., <br /> Project No.: 31001, Date: 1 Feb 2002, Revisions: 2/22/01, 8/15/01, 3/12/02, 5/12/02, <br /> 6/13/02'. Mr. Regan seconded. All agreed. <br /> Alexander M. Levine—Requests a Variance from Sections 174-31 and 174-47 of the j <br /> Zoning By-laws to vary the side setback requirements to allow for construction of a <br /> single-family home and pool on property located in a cluster development in an R-3 <br /> zoning district at 185 Willowbend Drive (Map 63 Parcel 70)Mashpee, MA. <br /> II I� <br /> Sitting: Edward M. Attorney Mills stated that the Petitioner is Ili <br /> seeking Variance relief of 9 feet from the side setback requirements to allow for <br /> construction of a pool on the subject property, which is located in a cluster development. <br /> Attorney Mills said that the unusual shape and sloping topography of the subject property � I <br /> required an enormous amount of fill, which factors severely limit the buildable area of <br /> the property. Attorney Mills stated that the proposed location of the pool abuts a 40-foot <br /> wide easement access to the golf course. U, <br /> Mr. Lee Daniels, an abutter at 165 Willowbend Drive, expressed opposition to the <br /> proposal.
