Crowe SP-02-77 32 Popponesset Avenue <br /> Map 70 Parcel 88 II j <br /> A Petition was filed on June 3, 2002 by Michael D. and Amy T. Crowe of <br /> Mashpee, Massachusetts for a Special Permit under Sections 174-25.A.8 and 174-25112 <br /> of the Zoning By-laws to allow for construction of an in-law apartment to a new dwelling <br /> and to park and use a trailer for temporary occupancy incidental to the construction of a <br /> single-family home on property located in an R-3 zoning district at 32 Popponesset <br /> Avenue (Map 70 Parcel 88) Mashpee, MA. <br /> I <br /> Notice was duly given to abutters in accordance with Massachusetts General I' <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 7, and June 14, 2002, <br /> a copy of which is attached hereto and made a part hereof. <br /> II i <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on ji it <br /> Wednesday, June 26, 2002, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, Robert G. Nelson and <br /> Frederick R. Borgeson. Mr. Regan stepped down and left the room. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Michael D. Crowe represented his Petition and stated that he has sold his j <br /> home on Cayuga Avenue and anticipates construction of the dwelling on the property <br /> located at 32 Popponesset Avenue to be completed within the next two months. Mr. <br /> Crowe is seeking permission from the Zoning Board of Appeals to construct an in-law <br /> apartment to the new dwelling and to house his family in the trailer on the subject <br /> property until construction of the new dwelling is complete. <br /> Mr. Matthew DeDecko, a local builder, expressed concern with the unappealing <br /> look of a trailer on the subject property and with the safety <br /> of children living on a <br /> construction site. No comments were received from abutters. <br /> I <br /> SPECIAL PERMIT CRITERIA <br /> Section 174.25.A.8 of the Zoning By-laws states: <br /> `Conversion of an existing dwelling to accommodate not more than two (2) families, <br /> provided that there is not external evidence of occupancy by more than one (1) family, <br /> and further provided that each dwelling unit resulting from such conversion shall have <br /> not less than seven hundred fifty (750) square feet of habitable floor space'. <br /> Section 174-25.I.12 of the Zoning By-laws states: <br />
