Mashpee Zoning Minutes—July 24, 2002 2 <br /> Board of Appeals <br /> i <br /> seek approval from the Planning Board and the ZBA with any proposed project changes. <br /> The Planning Board sent a memo dated July 19, 2002 to the ZBA recommending <br /> approval of the proposal. <br /> I <br /> Attorney Mills said that one of the Board of Trustees informed the Town Planner that <br /> changes had been made to the original Special Permit. Attorney Mills stated that over 14 <br /> years ago, the original developer cleared the buffer area to install additional parking <br /> spaces in an attempt to address the significant parking problem. The Petitioner is <br /> requesting a Modification to the Special Permit to allow for the additional parking and a <br /> Variance to allow for the encroachment into the buffer area. Attorney Mills said that no <br /> parking is proposed within the buffer zone. <br /> Mr. Eddy stated that the Petitioner has revised the proposal at the request of the Planning <br /> Board. Plans call for extensive plantings within the wooded buffer area. Attorney Mills <br /> said that the plans call for the dumpster to be relocated out of the buffer area. Mr. Eddy <br /> said that the proposal would total 11 additional parking spaces. Ms. Elizenberry <br /> questioned if the proposal would relieve the congestion. Attorney Mills stated that the <br /> Petitioner could use more parking spaces. Mr. Herman said that he feels that the changes <br /> would be adequate for the needs of the homeowners. Mr. Guerrera asked if the Petitioner <br /> plans to install any signs to direct traffic. j(� <br /> Building Commissioner Wheeler asked the Board to require the Petitioner to post a I, <br /> landscape and performance security. 1 <br /> Mr. Nelson referred to the certificate number on the submitted plan and asked if the <br /> subject property was registered land. He said that he was curious on how the 30-foot <br /> setback had been established. Attorney Mills said that he was not sure. ! �I <br /> No comments were received from abutters. <br /> Mr. Nelson moved to grant the following: <br /> • Modification to the Special Permit to allow for changes to the parking as it j <br /> exists in Parking Lot A as shown on Baxter, Nye & Holmgren, Inc. plan ! <br /> entitled '1741 Lowell Road, Mashpee, Massachusetts, Prepared for Quashnet ! <br /> Valley Condominiums, Drawing Number C-1, Date: 6/29/01, Rev. Date: <br /> 5/6/02, Drawing Number C-2, Date: 8/1/01, Rev. Date: 5/6/02, 5/27/02, <br /> 7/18/02, Drawing Number C-3, Date: 5/30/02, Rev. Date: 6/27/02, 7/18/02'. <br /> The Board determined that the proposal would: <br /> • be an improvement of a non-conforming condition. <br /> • be an improvement with relocation of the large dumpster out of buffer area <br /> and further away from a public road. <br /> • reduce encroachment into the buffer area. <br /> • be an improvement of the drainage problem due to installation of the major <br /> drainage system.
