Mashpee Zoning Minutes—August 28, 2002 3 <br /> Board of Appeals <br /> Ouashnet Valley West—Discussion regarding Proposed Modification to original Special <br /> Permit. <br /> Present: Messrs. Govoni,Nelson and Brem. Mr. Regan steps down and leaves the room. <br /> Attorney Timothy Neelon represented the Quashnet Valley West along with Mr. Kenneth <br /> Marsters. Mr. Neelon is before the Board at the request of the Planning Board to discuss <br /> the validity of the Quashnet Valley Special Permit. Mr.Neelon has a letter from the <br /> Building Inspector that the Planning Board was not able to see at their meeting. The <br /> petitioner has been fully permitted since 1992. Mr. Govoni states there has been <br /> significant progress on the permit since then. There were 68 lots and that has been <br /> reduced to 65 lots due to open space and drainage being added. They have created a <br /> buffer zone at the request of the Town Planner. Mr. Govoni feels there has not been any <br /> significant change to the original Special Permit. Mr. Neelon informs the Board that the <br /> lots are smaller due to the buffer zone. Mr. Govoni feels the Special Permit is still in <br /> effect and the changes are within the range of the original Special Permit. Mr. Marsters <br /> requests a letter be drafted to the Planning Board stating that the Special Permit is still in <br /> effect. Mr. Govoni feels there is not a problem and will draft a letter accordingly. <br /> II <br /> NEW PUBLIC HEARINGS <br /> Perfection Fence Company—Requests a Special Permit under Sections 174-24.E.8 and j <br /> 174-24.H.6 of the Zoning By-laws for permission to erect outdoor fencing to allow for <br /> outdoor sales on property located.in a C-1 zoning district at 38 Nathan Ellis Highway <br /> (Map 74 Parcel 20) Mashpee, MA. Owner of record: Mashpee Commons Limited <br /> Partnership. <br /> Sitting: Edward M. Govoni, Robert G. Nelson and James E. Regan, III <br /> John Renz, Vice President of Mashpee Commons Limited Partnership, represents the ! <br /> petitioner, Perfection Fence Company. The Petitioner is seeking permission to erect <br /> fencing to allow for outdoor sales on the subject property. <br /> No comments were received from abutters. j <br /> Mr. Govoni moves to grant the following: j ! <br /> iI <br /> ♦ To grant a Special Permit for Perfection Fence Company until December 31, 2003. ;! <br /> On or before that date Mashpee Commons Limited Partnership LLP must come back !
