Mashpee Zoning Minutes—August 28, 2002 4 <br /> Board of Appeals <br /> Carl Fiester—Requests a Special Permit under Section 174-25.A.8 of the Zoning <br /> By-laws to allow for the addition of an in-law apartment to an existing dwelling on <br /> property located in an R-5 zoning district at 755 Old Barnstable Road(Map 78 Parcel 82) <br /> Mashpee, MA. <br /> Sitting: James E. Regan, III, Robert G. Nelson and Edward M. Govoni. <br /> Ii <br /> Carl Fiester and Maureen Fiester are were told by the Building Department that they <br /> needed a Special Permit to construct an in-law apartment attached to their present home. <br /> Mr. Govoni asks Local Building Inspector Richard Hawryluk to review the proposal and <br /> he concludes that this project is well over the minimum required 750 square feet of space. <br /> Mr. Hawryluk informs the Board that the property located at 755 Old Barnstable Road is <br /> in an R-5 zoning district, therefore,the side setback for any new construction is 25 feet. <br /> The Board and Mr. Hawryluk determine that a Variance from the side setback <br /> requirements will be needed to allow for the proposal. Mr. Fiester informs the Board that <br /> the Building Department told him that he did not need a Variance. The Board determines j <br /> that inaccurate information was obtained. Mr. Govoni informs Mr. Fiester to file a <br /> Petition for a Variance. The Board continues this Petition for a Special Permit until <br /> September 25, 2002. <br /> Gateway Christian Center—Requests a Variance from Section 174-51.13 of the Zoning <br /> By-laws to exceed the maximum size limit to allow for installation of signage on property <br /> located in a C-2 zoning district at 628 Main Street(Map 13 Parcel 47) Mashpee, MA. <br /> Owner of record: Richard J. Dyer, Trustee. <br /> � I <br /> Sitting: James E. Regan, III, Edward M. Govoni and Robert G. Nelson <br /> Robert and June Condon represent the petitioner, Gateway Christian Center, and request <br /> a Variance to erect a sign on the subject property. Mr. Govoni asks to see some plans. <br /> The Condons lease the property from Mr. Richard Dyer and seek to enlarge the existing j <br /> sign. Mr. Nelson reminds the Board that the By-law allows for installation of one <br /> free-standing sign per property. Pictures are shown to the board. The sign attached to the I �! <br /> building is allowed to be within 10% of the aggregate square feet of the front of the <br /> building. Mr. Govoni feels both signs are legal and do not need a Variance. The <br /> Condons state that Mr. Wheeler told them they needed a Variance for these signs. <br /> � i <br /> Mr.Govoni moves to grant the following: <br /> I � <br /> ♦ A variance of 8 square feet to allow the proposed free standing sign to be erected r <br /> ♦ The attached sign on the building is within the zoning laws. �; I <br /> Mr. Regan seconds the motion.
