The fence will run approximately 80 feet from back fence of property to 2 A <br /> feet before the beginning of the deck where it adjoins the house. B <br /> 3. The fence will be 6 feet above the deck height which is approximately 2 C <br /> feet above the ground. Fence will be about 8 feet high. <br /> 4. The fence will be similar in design to Walpole Fencing "princeton" design <br /> and be natural in color. <br /> 5. The Rothschilds will be responsible for construction and maintenance of <br /> the fence. <br /> 6. The fence will be completed within 120 days of the filing of this decision. <br /> I <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 14 Pine Avenue and consists of 8,000 <br /> square feet. I jl <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. a literal enforcement of the By-laws would involve substantial hardship to <br /> the petitioner. <br /> 2. Desirable relief may be granted without substantial detriment to the public <br /> r <br /> good and without nullifying or substantially derogating from the intent or <br /> I <br /> purpose of the by-law. <br /> i <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the Petitioner <br /> met the criteria necessary for the granting of a Variance. Upon motion duly made and <br /> seconded, the Zoning Board of Appeals voted unanimously on September 25, 2002 to <br /> 1 <br /> grant the following: i <br /> 1. A 9.6 foot variance from the lot line that converges with 16 Pine Avenue, <br /> conditioned on the above-referenced specifications of a fence. <br /> 2.
