rt, <br /> gptA1V <br /> Town of Mashpee <br /> MASHPEE ZONING BOARD OF APPEALS A <br /> '•y' 16 great J�eck load JVorth <br /> Mashpee, Massachusetts 02649 <br /> Decision for a Variance B <br /> RE: James Kerrigan, Trustee, c/o Smith& Connolly 3 Lettie Lane C , <br /> Map 36 Parcel 47F <br /> V-02-114 <br /> A Petition was filed on September 3, 2002 by James Kerrigan, Trustee, c/o Smith <br /> &Connolly, requesting a Variance from Sections 174-32, 174-31 and 174-25 of the <br /> Zoning By-laws for a lot held contiguously with adjoining non-conforming lot to <br /> construct a single family house located in an R-5 and C-2 zoning district at 3 Lettie Lane <br /> (Map 36 Parcel 47F) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on November 1 and <br /> November 8, 2002, a copy of which is attached hereto and made a part hereof. <br /> Public Hearings were held on Wednesday, October 9, 2002 and Wednesday, <br /> November 13, 2002, at the Mashpee Town Hall and the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert G. Nelson, Marshall Brem <br /> and Frederick Borgeson. <br /> Attorney Kevin Kirrane represented the Petitioner James Kerrigan in the above- <br /> entitled matter. Mr. Kirrane has requested, on behalf of his client,to be allowed to <br /> develop this lot for residential purposes. He argues that although almost the entire lot is <br /> zoned for commercial use,it makes little sense to develop the other four parcels directly <br /> abutting this property for residential use and vote to maintain the commercial usage for <br /> , I <br /> this lot. Mr. Nelson informs Mr. Kirrane that the Board of Appeals has no authority to <br /> grant use Variances and moves to deny this Variance request. i <br /> I <br />
