Mashpee Zoning <br /> Board of Appeals James Kerrigan(3 Lettie Lane) V-02-114 <br /> Comments from abutters and/or concerned parties consisted of a memo (attached hereto) A <br /> from Mr. Thomas Fudala, Mashpee Town Planner stating his objections to granting this <br /> B <br /> variance. <br /> C <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the h <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> r <br /> A <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 3 Lettie Lane and consists of 19,641 square <br /> feet. <br /> � i <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> ;yr t <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner failed to meet the criteria necessary for the granting of a Variance.
