The Board feels <br /> i <br /> that the grandfathered zoning should be protected and moves to grant the Variance for lot j <br /> I <br /> size and required setbacks. <br /> GENERAL FINDINGS ( I a <br /> 1. the property is located at 57 Seconsett Island Road and consists of 6,865 <br /> square feet. f <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine �) j <br /> that there are circumstances relating to the shape and topography which affect this lot and II' <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. j <br /> ,I <br /> SPECIFIC FINDINGS t <br /> 1. that a literal enforcement of the By-laws would involve hardship to the I ! <br /> petitioners. I ; <br /> 2. that relief may be granted without detriment to the public good. <br /> 3. That there are circumstances relating to the shape and topography that affect <br /> I ' i <br /> the subject lot and not the district in which it is located. <br /> i <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> i <br /> made and seconded, the Zoning Board of Appeals voted unanimously on November 13, i <br /> } <br /> 2002 to grant the following: <br /> 1. a 14.6 foot Variance from the required front setbacks <br /> 2. a Variance of 33,222 square feet for lot size requirements. <br /> This Variance is conditioned upon plans from Cape & Islands Engineering, dated <br /> September 26, 2002, Plan No. 092602, File No. 147MA, Septic File No. 71.
