The ability of the neighborhood to safely absorb the increased traffic generated by the it <br /> proposed development is suspect. Further, as previously mentioned, the proposed development <br /> abuts a well field owned by the Trust, which services the adjacent residential community known <br /> as Lakeside Estates. The integrity of this water source is fragile under the best of conditions and j <br /> would be seriously threatened if the proposed development with its attendant use and storage of <br /> hazardous materials were permitted. <br /> With respect to "excessive levels of noise, vibrations, electrical disturbances", we point at <br /> that the very nature of an automobile repair and body shop invites excessive levels of noise, <br /> vibrations and electrical disturbances, which will affect the residents in the surrounding R-3 and <br /> R-5 Residence Zoning Districts. <br /> I� <br /> With respect to the"decrease of surface or groundwater quality or air quality", we point j <br /> out that the proposed development is located within a Groundwater Protection District as shown <br /> on Plan entitled "Town of Mashpee Groundwater Protection Overlay District" dated October <br /> 1999 and abuts the well field servicing the adjacent residential community of Lakeside Estates. ji: <br /> Further, the sanding of automobile body parts and the ancillary spraying of automobile paints <br /> will similarly impact the air quality of the neighborhood in a negative fashion. <br /> lj <br /> In this regard, we call your attention to the following: <br /> 1. Section 174-21.1 Stormwater Management of the Zoning By-Law, which provides <br /> "For any new non-residential development requiring a special permit....or <br /> 1, <br /> building permit for a building over 1,000 square feet, a system of stormwater <br /> management and artificial recharge or precipitation shall be required." <br /> "The permitting authority shall require the submission of sufficient plans and <br /> specifications to demonstrate the operation and effectiveness of the proposed <br /> stormwater management facilities and practices and shall require their implemen- <br /> tation and maintenance, including provisions for deed restrictions." <br /> II <br /> "No permit may be approved for a development unless the permitting authority l <br /> determines in writing that the proposed system of stormwater management and <br /> artificial recharge will achieve the purposes described in Subsection A." <br /> I <br />
