Section 174-27 Water Quality Report of the Zoning By-Law, which provides: jell <br /> "As part of any application for approval....of a special permit requiring approval <br /> by the Planning Board, the applicant shall submit 10 copies of a water quality ',� <br /> report regarding the proposed development, completed by a qualified firm, <br /> experienced in groundwater and surface water quality evaluation." <br /> "The water quality report must address whether the proposed development will <br /> produce any hazardous or toxic materials or if such materials will be stored on the <br /> site and, if so, specify how such materials will impact public health or safety", and : l' <br /> as further described in Subsection B of Section 174-27. <br /> I, <br /> 3. Section 174-81 Prohibited Uses of the Zoning By-Law, which provides "Within l <br /> the Groundwater Protection District, the following uses are prohibited: A. <br /> I;I' <br /> Storage of liquid petroleum products of any kind,...., waste oil retention facilities <br /> required by M.G.L. Chapter 21A, Section 52A....B. Storage of liquid hazardous <br /> materials, as defined by M.G.L. Chapter 21E, unless such storage is either in a <br /> freestanding container or within a building....L. Any use or establishment which <br /> qualifies as a small quantity generator or large quantity generator of hazardous <br /> wastes under the provisions of 310 C.M.R. 30.00...." <br /> There has been no submission by Canal which addresses or satisfies the requirements of <br /> Section 174-21.1 (Stormwater Management), Section 174-27 (Water Quality Report) and Section <br /> 174-76 et seq. (Groundwater Protection District). <br /> For the foregoing reasons, we request that the Board of Selectmen recommend that 1 <br /> Canal's petition and application be denied or, in the alternative, that same be referred to the Cape j' 1 <br /> Cod Commission for a more comprehensive review of the regional and environmental impact of <br /> the proposed development. <br /> Very truly yours, <br /> r � <br /> Daniel P.
