The plaintiffs are abutters to Lot 171, sharing a common sideline, and are parties in <br /> interest and persons aggrieved by the Decision of the Board of Appeals. <br /> 11. Lot 171 contains 26,384 square feet. <br /> 12. Lot 171 is located in the Mashpee Zoning District R-3, in which the minimum <br /> required lot size is 40,000 square feet. Attached hereto as Exhibit C is a copy of Mashpee <br /> Zoning Bylaw Section 174-31 which sets out the minimum 40,000 square foot <br /> requirement. <br /> 13.. On February 11, 1985 Lot 171 (263 84 square feet) and abutting Lot 170 (17,840 <br /> square feet), also shown on Plan No. 11408-24, were held in common ownership by Doris <br /> Sauer. <br /> 14. Doris Salzer became the owner of Lot 170 on May 15, 1964 (Certificate of Title <br /> No. 32678). She became the owner of Lot 171 on September 25, 1969 (Certificate of <br /> Title No. 46751). The two lots remained in common ownership until December 18, 1989 <br /> when Salzer deeded an undivided one-sixth interest in Lot 171 to the present owners <br /> Susan Fort, Karen Wiener and James Saizer, Trustees of the D.S. Trust; Salzer retained <br /> an undivided five-sixth interest (Certificate of Title No. 119310). On May 8, 1990, Saizer <br /> deeded an additional: interest in Lot 171 to the Trustees resulting in an undivided one-third <br /> interest in the Trustees and a two-thirds interest m Saizer(Certificate of Title No. <br /> 120454). On Marcii 1, 1991, Salzer deeded an additional interest in Lot 171 to the <br /> Trustees resulting in an undivided one-half interest in the Trustees and a one-half interest <br /> in Salzer (Certificate of Title No. 122764).
