5. The Board of Appeals consists of six members, all residents of Mashpee, who are: <br /> Edward M. Govoni of 43 James Circle — 451 N. Ellis, Mashpee, MA 02649, James E. <br /> Regan III P.O. Box 2100, 9 Steeple Street, Mashpee, MA 02649, Robert G. Nelson, 49 <br /> Seabrook Village, Mashpee, MA 02649, Richard T. Guerrera, 9 James Circle, Mashpee, <br /> MA 02649, Zella E. Elizenberry, 18 Terry Avenue, Mashpee, MA 02649, Frederick R. <br /> Borgeson, 10 Preakness Lane, Mashpee, MA 02649, and Marshall Brem, 381-5 Great <br /> Oak Road, Mashpee, MA 02649, and who maintain offices at Mashpee Town Hall, 16 <br /> Great Neck Road North, Mashpee, MA 02649. <br /> 6. The defendant William F. Hauck (hereinafter called `Building Commissioner") is <br /> the Building Commissioner of the Town of Mashpee and the Town's zoning enforcement <br /> officer pursuant to G.L. Ch. 40A Sec. 7, and he maintains principal offices at Mashpee <br /> Town Hall, 16 Great Neck Road North, Mashpee, MA 02649. <br /> 7. On December 2, 1999, pursuant to a written request by plaintiff Kevin F. <br /> Harrington for enforcement of the zoning laws, the Building Commissioner issued a ruling <br /> that Lot 171 was a buildable lot, a copy of the December 2, 1999 letter ruling is attached <br /> hereto as Exhibit A-1. <br /> S. By Notice of Appeal dated December 18, 1999 and filed December 27, 1999, the <br /> plaintiffs appealed the Building Commissioner's ruling to the defendant Mashpee Bcard of <br /> Appeals. A copy of the Notice of Appeal and attachments, is attached hereto as Exhibits <br /> A A-1 and A-2. <br /> 9. On February 9, 2000 the Board of Appeals held a public hearing on the plvntiffs' <br /> appeal. By Decision filed February 23, 2000 with the Mashpee Town Clerk, the Board of <br /> Appeals denied the plaintiffs appeal and upheld the Building Commissioner's letter ruling <br /> 3 <br />
