Mr. Govoni said that he would " <br /> feel uncomfortable rendering a decision against Town Counsel's advice. Apt r <br /> Attorney Lombardo asked if the Board would render a decision if the drive-through <br /> window is eliminated from the proposal. Mr. Govoni stated that the applicant would still <br /> be requesting a Use Variance which the Board cannot grant under the current Zoning <br /> ` By-laws. Mr. Govoni suggested that the applicant request a zoning change for the subject <br /> lot. <br /> INf Attorney Lombardo asked for permission to withdraw without prejudice the <br /> above-referenced Variance. �{ , <br /> F.. <br /> Mr. Govoni moved to accept the withdrawal. Her mother was owner of the subject properties and paid taxes on the lots with <br /> the intention of passing the lots on to some of her 11 children. Mrs. Hicks said that she <br /> became owner of the lots after her mother died. Amanda Way was paved and several <br /> family members developed lots on Amanda Way. <br /> Mr. Govoni informed Mrs. Hicks that an applicant must develop within 8 years after the C " l le <br /> w <br /> r Planning Board's approval of a subdivision. After the eight-year period,the subdivision �* <br /> does not exist,the lots go back to the original zoning and the applicant must petition the r ;•� <br /> Planning Board again.
