Lawton SP-00-21 2 <br /> Board of Appeals <br /> SII <br /> i <br /> GENERAL FINDINGS <br /> I. that the subject property is located at 89 Industrial Drive and consists of 1.38 '! <br /> acres. <br /> SPECIAL PERMIT CRITERIA <br /> Section 9 of Chapter 40A and Section 174-24C of the Mashpee Zoning By-law <br /> require that the permit granting authority determine that the proposed use and <br /> development are consistent with applicable law,rules and regulations;that there will be ! <br /> no adverse effect on public health or safety; that there will not be an excessive demand <br /> upon community facilities created as a result of the proposal; and that there will not be a <br /> significant adverse impact on the environmental factors listed in Section 174-24.C.2. <br /> SPECIFIC FINDINGS j <br /> 1. that the subject lot is in an Industrial zoning district. <br /> 2. that the proposal is an allowed use upon the granting of a Special Permit by <br /> the Zoning Board of Appeals. III I' <br /> 3. that the applicant has conformed to Design Review's recommendations for <br /> landscaping. <br /> 4. that there will be no adverse effect on public health or safety. <br /> 5. that there will not be an excessive demand upon community facilities created <br /> as a result of the proposal. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br /> I <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on February <br /> 23,2000 to grant a Special Permit. The Special Permit is conditioned upon compliance <br /> JI <br /> with the following: <br /> I�'ILI <br /> • the applicant must submit a performance security in the amount of$5,000 to <br /> guarantee completion of the landscaping. <br /> • the applicant must submit two stamped and engineered plans showing the 50-foot I' ! <br /> buffer and height of the fence. <br /> • the applicant must submit up-to-date, revised landscaping plans as agreed upon at the t <br /> Design Review Committee for the Board's files. <br />
