Mashpee Zoning Minutes—March 8, 2000 4 <br /> Board of Appeals <br /> Mr. Scott Goldstein, builder for the project, represented the applicants and stated that a <br /> Variance of 5 feet from the front setback requirements is being sought to allow for an roti <br /> addition to the existing kitchen. The addition would be 14 x 16 feet—a total of 224 <br /> square feet. <br /> ' f <br /> No comments were received from abutters. }+ , <br /> Mr. Borgeson moved to grant a Variance of 5 feet from the front setback requirements, 1� <br /> subject to criteria: 1, 2, 3, 4 and findings: 1, 3, 4 and that the addition would be no further <br /> back than the original dwelling. Domolky—Request a Special Permit under Section 174-17 of the <br /> Zoning By-laws to allow for additions to a pre-existing, non-conforming home located " <br /> in an R-3 zoning district at 26 Spoondrift Circle (Map 111 Block 120)Mashpee, MA. h �a <br /> Sitting: Edward M. Govoni, Richard T. Guerrera and Frederick R. Borgeson. <br /> Mr. Michael Grotzke of the Phoenix Group represented the applicants and submitted <br /> photos of the subject lot and stated that the house was built in 1962. The dwelling is ; <br /> a pre-existing, non-conforming structure. The proposal is to expand the bathroom by <br /> three feet. The expansion would result in less of a non-conformance than the existing .r�. <br /> dwelling. +� ;•�,A <br /> Vol <br /> The Conservation Commission considered the proposal to be of a minor nature and has <br /> already issued an Order of Conditions. <br /> No comments were received from abutters. <br /> Mr. Guerrera moved to grant the Special Permit, subject to findings: 2, 5, 7 and citing the <br /> Goldhirsch case—expansion of a non-conforming structure and the fact that the , <br /> expansion would be less of an encroachment on the setback requirements than the <br /> existing structure. Bulger—Request a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the side setback requirements to allow for construction of <br /> a single-family dwelling on property located in an R-3 zoning district at 51.Monahansett <br /> Road(Map 123 Block 10 1)Mashpee, MA. (Modification to Variance V-99-116.) <br /> Sitting: Edward M. Govoni,Marshall A Brem and Frederick R. Borgeson. <br /> Mr. John Slavinsky of Cape &Islands Engineering represented the applicants and stated <br /> that the Conservation Commission has demanded that the project be constructed 35 feet <br /> back from the work limit. The Board granted a Variance to allow for construction of the <br /> house to be cantilevered two feet on each side. After consulting with the architect,the r <br /> Bulgers discovered that the proposal would pose serious financial and aesthetic <br /> complications.
