Mashpee Zoning Terrance V. & Sandra A. McNeil V-00-73 2 <br /> Board of Appeals <br /> At the continued hearings on March 22, 2000, Mr. John Slavinsky of Cape & <br /> Islands Engineering represented the applicants and referred to the revised plans. Mr. <br /> ISI I'! is <br /> Slavinsky withdrew the request for a Variance from the front and rear setback i <br /> i <br /> requirements. The applicants are requesting a Variance of 2 %2 feet from the side setback <br /> requirements and a Variance from the lot coverage requirements. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS I II <br /> 1. that the subject lot is located at 30 Jackbon Road and consists of 7,5000 <br /> square feet. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and �I <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> I �I <br /> SPECIFIC FINDINGS <br /> 1. that there are circumstances relating to the shape and topography that affect <br /> the subject lot and not the district in which it is located. I <br /> 2. that relief may be granted without detriment to the public good. j <br /> 3. that relief may be granted without derogating from the intent or purpose of the I j <br /> I <br /> By-laws. <br /> j <br /> 4. that the lot pre-dates zoning. <br /> I <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the <br /> in of a Variance. Upon motion duly <br /> I <br /> made and seconded,the Zoning Board of Appeals voted unanimously on March 22, h <br /> 2000 to grant a Variance of 2 1/2 feet from the sideline setback requirements and a <br /> Variance of 2% from the lot coverage requirements. The Variance is conditioned upon <br /> compliance with Cape &Islands Engineering plan entitled"Plot Plan of Land Located <br /> in Mashpee—Mass., Prepared for Terrance V.
