Mashpee Zoning Minutes—March 22, 2000 4 '` y
Board of Appeals
Mr.Nelson suggested that the hearing should be continued to allow Mr. Moore the
privilege of going to the Selectmen to inquire if they would grant him a license to
operate. Mr. Nelson also requested that Mr. Moore submit a professionally surveyed plan , a'
showing the physical distance from the right-of-way to the parking lot in order for the
Board to determine the 50-foot setback. Mr.Nelson said that a continuance of the r y ,
hearing would also provide the abutters an opportunity to compare the Assessor's records .
with their own records of Deer Crossing property owners.
k'
Mr. Hauck said that he would supply the Board members with a copy of the state statute.
He said that the statute would clarify questions that the Board has regarding the '
application. .1 A
Mr. Moore said that he cannot request a license from the Board of Selectman until after
the Zoning Board has rendered its decision. p'
"j "
Mr. Hauck questioned what would happen to Mr. Moore's current license if he receives
permission to operate at the new location. Mr. Brem questioned if the cars for sale would
be displayed on both sides of the street. Ed O'Connor, an abutter, asked for the purpose
of a wholesale license. Mr. Moore replied that he would not display cars for sale on both ,
sides of the street and that he would like to retain his wholesale license because it is a
very valuable license to own. He said that he would give up his license to display one car
for sale at a time at his current location if the Board requests him to do so.
Mr. Moore expressed confusion as to what exactly the Board wanted him to do. Mr.
Regan said that the Board wants to know how the Board of Selectmen would react to the
application. The Board wants to avoid granting another Special Permit that the Board of
Selectman would refuse to license. Mr. Regan also stated that the Board needs
clarification as to whether or not the Board of Selectmen requires a repair shop on site. If
on-site repair is a pre-requisite of the Board of Selectmen, the Zoning Board would r '
demand a withdrawal of the application.
Gail Marcantonio, an abutter, asked the difference between a car broker and a car '•,
salesman. Mr. Moore stated that there is no difference. He said that here is a difference
between a wholesale and retail license. i.
Mr.Nelson moved to continue the hearing until May 10, 2000.
