(Owner of record: K. C. Realty Trust.) <br /> I . <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on March 3 and March 10, <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, March 22, 2000, at which time the following members of the Zoning Board „ I <br /> of Appeals were present and acting throughout: James E. Regan III, Robert G.Nelson <br /> and Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> The Board received a request from Cape & Islands Engineering on behalf of the <br /> applicant for a continuance of the hearing. The Board voted unanimously to continue the <br /> hearing until April 26, 2000. <br /> I I � <br /> At the Public Hearings on April 26 2000 Mr. John Slavins <br /> g p ky of Cape &Islands ; I <br /> Engineering represented the applicant and submitted photos of the lot. Trash, cars and <br /> other debris have been dumped on the site for years. Mr. Webster,new owner of the lot, <br /> also attended the meeting. He stated that the lot would be cleared prior to the construction {' <br /> of a new home. I H i l I <br /> I II i <br /> I <br /> The Conservation Commission required delineation of the saltwater habitat. The <br /> existing structure is four feet away from the saltmarsh line and the proposed structure <br /> would be eight feet away from the saltmarsh line.
