Mashpee Zoning Alberto Velella, Trustee V-00-78 2 <br /> Board of Appeals <br /> Mr. Ron Francour, an abutter, expressed approval of the proposal and mentioned <br /> that he was happy that something was being done to improve the appearance of the lot. �+ <br /> i <br /> No other comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 407 Monomoscoy Road and consists of ' <br /> 41,400 square feet. ! <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would j <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> 1. that there are circumstances relating to the shape and topography that affect <br /> the subject lot and not the district in which it is located. <br /> 2. that a literal enforcement of the By-laws would involve hardship to the <br /> Petitioner. l <br /> 3. that relief may be granted without detriment to the public good. I ;' <br /> 4. that relief may be granted without derogating from the intent or purpose of the <br /> By-laws. Ili <br /> 5. that the subject property is impacted by wetlands. i �I <br /> 6. that the installation of a new septic system would be an improvement to the lot <br /> and to the neighborhood. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals foun <br /> p g pp d that the i <br /> applicant met the criteria necessary for the granting of a <br /> Variance. Upon motion duly I , <br /> made and seconded,the Zoning Board of Appeals voted unanimously on April 26, 2000 <br /> to grant a Variance of forty-two(42)feet from the setback requirements to the water and <br /> the wetlands. The Variance is conditioned upon compliance with the following: <br /> 1. that the subject lot shall be completely cleared of all trash and debris. <br /> 2. that the existing structure shall be demolished prior to construction of the new <br /> dwelling on the subject lot. <br /> 3.
