Attorney Mills submitted a I I <br /> copy of the extensive landscaping plan. <br /> i ) it <br /> No comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at Falmouth Road and consists of 1.25 IIT, <br /> acres of land. <br /> SPECIAL PERMIT CRITERIA <br /> Per Section 9 of Chapter 40A and Section 174-24C of the Mashpee Zoning I, II <br /> By-law,the Board determined the following: �l <br /> 1. that the proposed use and development are consistent with applicable law, I'II'i <br /> rules and regulations. <br /> I <br /> 2. that there will be no adverse effect on public health or safety. I t <br /> 3. that there will not be an excessive demand upon community facilities created ] <br /> as a result of the proposal. <br /> i� <br /> 4. that there will not be a significant adverse impact on the environmental factors <br /> I Ii <br /> listed in Section 174-24.C.2. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the �II II <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on June 14, <br /> 2000 to grant a Special Permit. The Special Permit is conditioned upon compliance with I ii <br /> I <br /> the following: <br /> 1. Cape & Islands Engineering plan entitled: "Proposed Retail & Office <br /> Buildings Located in Mashpee—Mass.,Prepared for Ronald Mycock,Plan <br /> No. 060399, Date: June 3, 1999, Revised 12/15/99, 12/20/99, 02/04/00, <br /> 02/9/00, 02/27/00, 4/13/00, 5/4/00". <br /> 2. that the applicant shall deposit with the Zoning Board of Appeals a cash <br /> security in the amount of$5000 to guarantee performance of the landscaping <br /> prior to any construction. The deposit will be forwarded to the Town <br /> i <br /> Treasurer's Office.
