1 <br /> Mashpee Zoning Duck Pond Limited Partnership SP-00-83 2 <br /> Board of Appeals <br /> � I <br /> SPECIAL PERMIT CRITERIA <br /> Per Section 9 of Chapter 40A and Section 174-24C of the Mashpee Zoning <br /> By-law,the Zoning Board of Appeals determined: <br /> 1. that the proposed use and development are consistent with applicable law, <br /> rules and regulations; <br /> I I; it <br /> 2. that there will be no adverse effect on public health or safety; <br /> 3. that there will not be an excessive demand upon community facilities created <br /> as a result of the proposal; and <br /> 4. that there will not be a significant adverse impact on the environmental factors <br /> j 1, II <br /> listed in Section 174-24.C.2. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the !� <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion ! j <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on March 22, <br /> 2000 to grant a Special Permit to allow the applicant to erect a six-foot chain link fence <br /> pP <br /> covering an area of approximately 100 feet x 60 feet.
