East, Jr. &Allison Pat East SP-00-125 2 <br /> Board of Appeals <br /> SPECIAL PERMIT CRITERIA'. <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General �! <br /> Law Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> SPECIFIC FINDINGS <br /> 1. that he proposed construction does not conform to the setback requirements <br /> and the Board has granted a Variance. <br /> I <br /> 2. that the By-laws allow for demolition and construction of a new dwelling <br /> because there is a pre-existing,non-conforming structure on the subject <br /> property. <br /> 3. that while the proposed construction will increase the non-conforming nature <br /> of the structure,the changes will not result in a structure or use which is more <br /> detrimental to the neighborhood than the prior non-conforming structure and <br /> its use. <br /> 4. that the immediate neighborhood consists of single-family homes of similar <br /> size. Many have been improved with additions or reconstruction. <br /> 5. that installation of a new septic system would be an improvement to the <br /> property. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on June 14, <br /> 2000 to grant a Special Permit. The Special Permit is conditioned upon compliance with <br /> the following: <br /> 1. Cape & Islands Engineering plan entitled: "Septic System Upgrade, Proposed <br /> Sewage Disposal System Plan, Prepared for George East, Hse.No. 22 <br /> Wilson's Grove, Mashpee—Mass., Plan No. S032200, Date: March 22, <br /> 2000". <br /> 2. New England Design plan entitled: "George East Residence, 22 Wilson's <br /> Grove, Mashpee, MA., File Name: OOOIAI, Date 04/25/00". <br />
