Brady of <br /> Mashpee, Massachusetts for a Variance from Section 174-33 of the Zoning By-laws <br /> for permission to vary the setback requirements from water and wetlands to allow for <br /> construction of an attached garage with a den and deck overhead on property located <br /> in an R-3 zoning district at 256 Monomoscoy Road(Map 120 Block 56)Mashpee, MA. <br /> Owner of record: Richard P. Brady, et al Trustees. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given b Oil; <br /> g y publication in The Cape Cod Times, a Fi <br /> newspaper of general circulation in the Town of Mashpee, on June 12 and June 19, 2000, <br /> a copy of which is attached hereto and made a part hereof. <br /> I <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> P .i <br /> Wednesday, June 28, 2000, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III,Robert G. Nelson <br /> and Richard T. Guerrera. Mr. Govoni stepped down and left the room. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. and Mrs. Brady represented their Petition and stated that they wish to expand <br /> their living space by constructing an attached garage and deck to their existing home. The <br /> request is for a Variance to allow the proposed second-floor deck to be less than 50 feet <br /> from the water and wetlands. Mr. and Mrs. Brady also said that they do not plan to add <br /> any extra bedrooms to the existing dwelling. <br /> The Conservation Commission has approved the proposal. <br /> Mr. Nelson expressed concern with the submitted plan. The plan does not show <br /> square footage of the lot or the total lot coverage with the proposed construction. Mr. <br /> Nelson also said that the northerly lot line on the plan is referred to as a fence and does <br /> not reveal any dimensions. The plan and the Assessor's map reveal a discrepancy in the <br /> frontage of the subject lot. <br /> The Board voted unanimously to continue the hearing until July 12, 2000 to allow <br /> the applicant an opportunity to submit the Deed Reference to the Registry plan and to <br /> submit engineering plans illustrating proposed lot coverage,true dimensions on the <br /> property line,total square footage and square footage of upland and wetland areas of the <br /> subject lot. <br /> 1 <br />
