Mashpee Zoning Richard P. &Julia A. Brady V-00-132 2 <br /> Board of Appeals <br /> 5; <br /> At the continued hearings on July 12, 2000,Mr. and Mrs. Brady represented their aj <br /> Petition. As requested by the Board,the revised plan shows proposed lot coverage, true <br /> dimensions on the property line,total square footage and square footage of upland and <br /> wetland areas of the subject lot. <br /> Mr. and Mrs. Brady also submitted a copy of the Deed for 256 Monomoscoy <br /> Road from the Barnstable County Registry of Deeds showing the purchase by a previous <br /> owner of an additional 14 feet of frontage from the abutting lot. The Deed Reference is <br /> Ijf <br /> Book 1339 Page 761. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 256 Monomoscoy Road and consists of <br /> 14,925 square feet. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> � . <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> 1. that there are circumstances relating to the shape and topography that affect <br /> the subject lot and not the district in which it is located. <br /> 2. that a literal enforcement of the By-laws would involve hardship to the <br /> Petitioner. <br /> 3. that the subject property fronts on Great River and is impacted by wetlands. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that <br /> the Petitioner met the criteria necessary for the granting of a Variance. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on July 12, <br /> 2000 to grant a Variance of 20 feet from the setback requirements to the water and <br /> wetlands. The Variance is conditioned upon compliance with Cape &Islands <br /> Engineering plan entitled"House 256 Monomoscoy Road,Proposed Site Plan Located <br /> in Mashpee—Mass., Prepared for Richard P. Brady, Plan No. 010797,Date: Jan. 7, 1997, <br /> Rev'd 5-02-00, 5-10-00, 7-5-00". <br />
