Russo, Trustee, Russo Realty <br /> Trust, of Marstons Mills, Massachusetts for a Special Permit under Sections 174-25.F.3, <br /> 174-80 and 174-82 of the Zoning By-laws for permission to construct an automobile <br /> repair shop within the Groundwater Protection District on property located in a C-2 <br /> zoning district at 58 and 64 Algonquin Avenue (Map 72 Block 112 and Block 113) <br /> Mashpee, MA. Owner of record: William E. Crowell. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a j <br /> newspaper of general circulation in the Town of Mashpee, on July 21 and July 28, 2000, <br /> a copy of which is attached hereto and made a part hereof. <br /> This Petition has been continued from the August 9, 2000 Public Hearings to <br /> allow the Board an opportunity to refer the Petition to the Board of Health, Conservation <br /> Commission,the DPW and the Planning Board. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 13, 2000, at which time the following members of the Zoning p <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Richard T. Guerrera. �, I <br /> ':I <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Messrs. Robert F. Mills, Charles W. Russo, Bill Lieberman and Terry Luff <br /> represented the Petition. <br /> Attorney p p <br /> e Mills stated that Mr. Russo has operated an automobile repair shop 0 on <br /> Route 130 in Sandwich in the Sandwich Groundwater Protection district for over 20 <br /> years. The DEP considers Mr. Russo's operation"a very small generator of hazardous <br /> waste"; which means that he is allowed to generate 100 kilograms of hazardous waste per <br /> month. Attorney Mills said that Mr. Russo's automobile repair shop has not accumulated <br /> 100 kilograms in 20 years of operation. <br /> The project exceeds all the land space use and parking requirements of the Zoning <br /> By-laws with over 80,000 square feet, 300 feet of frontage, sideline setbacks of 50 feet <br /> and rear setbacks of 47 feet. The proposal calls for only 12% lot coverage. Attorney <br /> Mills confirmed that the Petitioner has completed the Design Review and the Technical <br /> Review processes. <br />
