Mashpee Zoning New Seabury Properties, LLC 3 <br /> Board of Appeals SP-00-151 <br /> At the continued hearings on August 23, 2000,Attorney Robert F. Mills <br /> represented the Petition and requested a Withdrawal of a portion of the application <br /> regarding a Written finding on the property located at 78 Main Street, Map 47 Block 10. <br /> The Board voted unanimously to grant the request. <br /> At the on-site visit on August 21, 2000,Attorney Mills submitted a plan from the <br /> Building Department that reveals the layout of the entire facility,the parking area and <br /> septic and leaching systems. There is sufficient parking for the subject properties. The <br /> Board of Health has designated the facility as a 20-unit motel with a maximum <br /> occupancy of 65. <br /> Attorney Mills referred to the letter dated August 21, 2000 from the Stratford i <br /> Ponds Condominium Trust expressing opposition to the proposed use of the motel as a <br /> "dormitory residence" for New Seabury employees. He said that the motel would not be <br /> used as a dormitory in the traditional sense of a college dormitory. The Petitioner has the <br /> option of moving its employees from one room to another every 29 days or requesting <br /> from the Zoning Board of Appeals a change in use from an R-1 use to an R-2 use. <br /> Attorney Mills conducted an investigation at the Barnstable County Registry of j <br /> Deeds and found nothing of record against the subject properties regarding any Variances <br /> or Special Permits granted by the Zoning Board of Appeals. <br /> Ms. Cowan, a direct abutter, expressed opposition to the proposal and said that the I'l <br /> noise and traffic would be detrimental to her lifestyle and her living conditions. She said <br /> that the proposal would affect the value of her property. <br /> Ms. Marlene Perry said that she represented the property owners of 53 Main <br /> Street and 61 Main Street and concurred with Ms. Cowan's remarks. Ms. Perry stated I' <br /> that changing the use of the motel would change the "whole flavor of the neighborhood" L, <br /> and objected to having children living on the properties. <br /> Ms. Elizabeth Oakley, a direct abutter at 71 Main Street, expressed concern with <br /> noise and the "type of character" of some of the employees. <br /> Mr. Chuckie Green, a resident at 105 Main Street,voiced concern with a large <br /> group of young people living together for extended periods of time and creating noise and <br /> other problems in the neighborhood. <br /> Ms. Anna Lewis, a resident at 101 Main Street for more than 20 years, expressed <br /> her approval of the way that Dr. and Mrs. Soliz have run the motel and stated that she is <br /> opposed to the dormitory-type use of the subject properties. <br /> I <br /> Mr. Brem said that New Seabury Properties, LLC can proceed with the proposal <br /> even if it does not receive approval from the Zoning Board of Appeals. He raised the <br /> issue of hotel/motel taxes that the Town would lose with the proposal. <br /> L <br />
