Mashpee Zoning Minutes—August 23, 2000 9 -" <br /> v <br /> Board of Appeals <br /> Mr. Wheeler stated that a porch overhang is allowed. However, the proposal calls for <br /> construction of porch columns for which the Petitioner is seeking permission from the "gyp <br /> ZBA. <br /> Mr. Sandler objected to the fact that the only notification that he and his parents received ,'• '�� , <br /> concerning the project was the ZBA Public Hearings Notice. He indicated that he would <br /> have preferred a phone call from the Petitioner. Mr. Brem stated that notification from y' <br /> the ZBA is normally the way that abutters are contacted. <br /> Messrs. Regan and Guerrera asked Mr. Sandler to clarify his objection to the proposal. <br /> Mr.Nelson confirmed that lot coverage would be less than 20%. Mr. Sandler asked the A011, tl�o- <br /> legal basis for the Variance. Mr. Regan said that the shape and topography of the lot and w <br /> its close proximity to the wetlands create hardship for the Petitioner. : <br /> Mr. Sandler reviewed the plans and then asked for a few minutes to discuss the proposal <br /> with his parents. After a few minutes, he informed the Board that his parents no longer <br /> gtll' <br /> object with clarification of the setback issue and grandfathering of the subject lot. Mr. <br /> Sandler said that they would appreciate an introductory phone call from the new <br /> neighbors at some point. <br /> No other comments were received from abutters. <br /> I <br /> Mr. Regan moved to grant a Variance of 6 feet to allow for construction of the porch, <br /> subject to criteria 1, 2, 3, 4 and findings 1, 2 and installation of a new denitrification <br /> system. Mr. Nelson seconded. Benway, et al Trustees, Mary A. Benway Q. P. Trust. <br /> The Board received a request from Cape & Islands Engineering on behalf of the <br /> Petitioner for a continuance of his Petition to allow for Conservation Commission <br /> approval. Mr. Regan moved to continue the hearing until September 13, 2000. Mr. Brem ' <br /> seconded. All agreed. <br /> The Board received a request from Edgar R. Quiet to Withdraw his application.
