Mr. Drowne said that the plan was <br /> developed in compliance with the original Special Permit. Mr. Regan indicated that the <br /> Petitioner would have to request a Variance from the Board to allow for the proposed <br /> number of parking spaces. <br /> Ms. Mary Fox, a neighbor, expressed concerns with parking on Frog Pond Close. <br /> She also questioned if fire apparatus and emergency vehicles would be able to safely gain <br /> access to the street. <br /> Messrs. Cimeno and Quinn, direct abutters, stated their concerns with the parking <br /> problems,the fire and safety apparatus access and the excessive trash and litter on Frog <br /> Pond Close. Mr. Cimeno said that he favors the proposal and improvement of the subject <br /> property. t <br /> Mr. Brem said that the ZBA has no authority over parking and traffic issues. He <br /> suggested that the neighbors contact the proper authorities with jurisdiction in those areas <br /> of concern. Building Commissioner William F. Hauck suggested that the neighbors <br /> could petition and/or pay for the installation of"No Parking signs" on Frog Pond Close. <br /> Mr. Regan said that the Petitioner must research the original Special Permit and <br /> the Zoning By-laws and make adjustments to the Petition for a Special Permit. d' <br /> The Board voted unanimously to grant a Continuance/Extension of the Request I` <br /> for a Special Permit, SP-00-167. <br /> At the continued hearings on January 10, 2001,the Board was informed by the <br /> Building Commissioner that construction of a bulkhead, deck and shed has begun on the <br /> subject property without Conservation Commission approval and without appropriate <br /> building permits in hand. The Building Commissioner has ordered a Cease and Desist of <br /> all related work. <br /> Because of the above-referenced violations,the Board voted unanimously to <br /> Deny Without Prejudice the Request for a Special Permit, SP-00-167. <br /> II <br /> i, <br /> '` 4 <br />
