Eydenberg j <br /> of Lancaster, Massachusetts for a Modification to Special Permit, SP-00-29, under <br /> Section 174-20 of the Zoning By-laws to allow for demolition of an existing dwelling <br /> and construction of a single-family home on property located in an R-3 zoning district <br /> at 43 Kim Path(Map 117 Block 90)Mashpee, MA. <br /> ,I <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on September 15 and <br /> September 22, 2000, a copy of which is attached hereto and made a part hereof. <br /> , i <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 4, 2000, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni,Richard T. Guerrera <br /> i <br /> and Zella E. Elizenberry. Mr. Regan stepped down and left the room. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> 'i <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape & Islands Engineering stated that the Board granted <br /> the Petitioner permission to expand a pre-existing, non-conforming dwelling in Special <br /> Permit, SP-00-29. After consulting with the Building Department and researching state <br /> building codes,the Petitioner decided to demolish the existing four-bedroom home and <br /> reconstruct a three-bedroom home on the subject property. <br /> Mr. Slavinsky clarified the plans and stated that the proposed dwelling would be a <br /> two-story home. Lot coverage would be reduced from 27.3%to 24%. ! <br /> The Conservation Commission has approved the project. <br /> Ms. Marjorie Katsoulis, a resident of Mashpee, asked if the abutters had been <br /> notified of the change in the proposed elevation of the dwelling. Mr. Govoni confirmed <br /> that Notice was given to abutters and by publication in The Mashpee Enterprise. j <br /> Mr. Slavinsky said that the proposed height of the building at 28 feet is below the Ih <br /> height restriction in the Popponesset Overlay District. <br /> i <br />
