Eydenberg SP-00-178 2 m <br /> Board of Appeals = <br /> INS <br /> No comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 43 Kim Path and consists of 6,650 <br /> i <br /> square feet. <br /> i <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> SPECIFIC FINDINGS <br /> 1. that the proposed construction does not conform to the setback requirements <br /> and the Board has granted a Variance. <br /> 2. that the immediate neighborhood consists of single-family homes of similar <br /> size. Many have been improved with additions or reconstruction. <br /> 3. that the changes will not result in a structure or use which is more detrimental <br /> to the neighborhood than the prior non-conforming structure and its use. <br /> 4. that the dwelling would be reduced from a four-bedroom to a three-bedroom <br /> home. <br /> 5. that the installation of a new septic system would be an improvement to the <br /> property. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on October 4, <br /> 2000 to grant the following: <br /> 1. a Special Permit to demolish the existing dwelling. <br /> 2. a Variance of 10 feet from the setback requirements on the southeast side of j <br /> the subject property. <br /> 3. a Variance of 4% from the lot coverage requirements. <br /> The Special Permit is conditioned upon compliance with Cape&Islands <br /> Engineering plan entitled"Additions & Septic Upgrade, Proposed Sewage Disposal <br /> System Prepared for Jeffrey Eydenberg, Hse.No. 43 Kim Path, Mashpee, Mass.,Date: <br /> Nov. 10, 1999, Rev: 02/07/00, 02/10/00, 8-20-00, Plan No. 5111099". <br /> I <br /> i <br /> � I <br />
