Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on September 15 and <br /> September 22, 2000, a copy of which is attached hereto and made a part hereof. j <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> I <br /> Wednesday, October 11, 2000, at which time the following members of the Zoning <br /> II � . <br /> Board of Appeals were present and acting throughout: Edward M. Govoni, James E. <br /> Regan III and Robert G. Nelson. G 1 <br /> This Petition has been continued from the October 4, 2000 Public Hearings. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Michael Grotzke of the Phoenix Group represented the Petition and stated <br /> that a Variance is required because the subject lot lies within the ACEC. The proposal <br /> meets Little Neck Bay's 30-foot setback requirement. Extensive replanting is planned for <br /> the easterly side of the lot. <br /> Mr. Govoni read a letter from an abutter, Mr. Steven Croopnick, expressing <br /> concern with protecting the "value, aesthetics and quiet enjoyment of his property. <br /> Mr. Croopnick also stated that he is opposed to the project because of the proposed <br /> elevation of the basement and the height of the first floor. <br /> 1 <br />
