i > <br /> Mashpee Zoning Charles H. & Carolann Robbins V-00-174 2 k <br /> Board of Appeals = <br /> o� <br /> No other comments were received from abutters. =� <br /> n <br /> GENERAL FINDINGS <br /> I ) <br /> 1. that the subject lot is located at 4 Waterline Drive North and consists of <br /> 19,200 square feet. p <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> 1. that there are circumstances relating to the shape and topography that affect <br /> the subject lot and not the district in which it is located. <br /> 2. that a literal enforcement of the By-laws would involve hardship to the I' j <br /> Petitioner. <br /> 3. that relief may be granted without detriment to the public good. <br /> 4. that relief may be granted without derogating from the intent or purpose of the <br /> By-laws. <br /> 5. that the subject property is impacted by wetlands. <br /> 6. that the lot has been maintained as a separate buildable lot on the Assessor's <br /> Records and is subject to betterments from the Water District. <br /> 7. that the proposed lot coverage of 17.2% is well below the allowed 30%. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded,the Zoning Board of Appeals voted unanimously on October 11, <br /> 2000 to grant a Variance of 50 feet to the top of the coastal bank. The Variance is <br /> conditioned upon the following: <br /> 1. The Phoenix Group plan entitled"Robbins Residence, 4 Waterline Drive N., <br /> New Seabury, MA., Map 120/Block 174, Project No. 39222, Date: 10 Dec <br /> 1999, Revisions: 4/25/00, 5/11/00, 6/27/00, 6/30/00, 8/14/00, 9/8/00, 9/13/00, <br /> 9/28/00". <br /> 2. that the Petitioner shall not make any grade changes on the subject property <br /> until the Petitioner submits an amended order and receives approval from the <br /> i <br /> Conservation Commission, Zoning Board of Appeals and Board of Health. j <br />
