Mashpee Zoning Minutes—October 11, 2000 3 <br /> Board of Appeals ' <br /> Mr. Govoni said'that any change or expansion under 10, 000 square feet would fall under „ •d,, 9 <br /> ZBA jurisdiction and any proposal over 10,000 square feet would fall under Planning <br /> Board jurisdiction. f <br /> Greg Taylor, Director, DPW, sent a memo that found"no issues related to the Mashpee <br /> DPW." <br /> Mr. Govoni suggested that the Board send the Petition along with a letter to Town <br /> Counsel for advice. He invited Attorney Mills to offer input when the documents are sent <br /> to Town Counsel. <br /> Mr. Regan said that the Petition has been put together well. He also stated that the Cape <br /> Cod Rehab in the Industrial Park offers similar services. <br /> Mr. Hauck confirmed that the proposal is a change in use and would require a special <br /> a <br /> permit. <br /> �9pl�Iua. <br /> Mr. Govoni moved to continue the Petition until a reply has been received from Town <br /> Counsel. Mr.Nelson seconded. All agreed. <br /> Paul J. &Anne M. Powers, Sr.—Request a Variance from Sections 174-33 and 174-86.D <br /> of the Zoning By-laws for permission to vary the setback requirements to water and <br /> wetlands to allow for construction of an addition to an existing home on property located NHIVe, <br /> within the ACEC in an R-3 zoning district at 16 Bayview Road(Map 119 Block 38) <br /> Mashpee, MA. <br /> Sitting: Edward M. Govoni, James E. Regan III and Robert G.Nelson. <br /> Attorney Jeffrey W. Oppenheim,Architect Barbara Jones and Engineer Barbara Frappier <br /> represented the Petition. Mr. and Mrs. Powers also attended the meeting. <br /> Attorney Oppenheim said that plans call for removal(to another site) of the existing <br /> three-bedroom home and construction of a new three-bedroom home,utilizing the °k <br /> existing foundation with cantilevers. A small,new foundation would also be installed <br /> with two decks. Mr. and Mrs. Powers plan to move to Mashpee on a <br /> year-round basis after completion of the proposal. Conservation Commission has II <br /> approved the project. <br /> The Board of Health has approved installation of a Title V septic system. <br /> i <br /> Ms. Frappier from Warwick&Associates, Inc. referred to maps,plans and photos of the <br /> subject lot. She went into a long dissertation and said that hardship exists because of the <br /> f <br /> close proximity of the top of the coastal bank to the property.
