'I <br /> Block 75)Mashpee, MA. Owner of record: Fred& Marie M. Bohnenberger. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given byublication in The Mashpee Enterprise, <br /> p P � , <br /> a newspaper of general circulation in the Town of Mashpee, on November 3 and <br /> November 10, 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, November 22, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert G. Nelson, Zella E. <br /> Elizenberry and Frederick R. Borgeson. Mr. Regan stepped down and left the room. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the l <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Michael J. Borselli from Holmes &McGrath represented the Petition and <br /> stated that the pre-existing, non-conforming, nine-bedroom dwelling would be <br /> 'I <br /> demolished and replaced with a new four-bedroom home. ISI <br /> The proposal has received Conservation Commission approval. The Board of <br /> Health has approved the proposed installation of a new Title V septic system. <br /> Mr. Borgeson questioned the exact location of the new construction. Mr. Borselli <br /> indicated that the Petitioner would also need a 23-foot variance from the water and I' <br /> wetlands for construction of a deck. The Petition for that Variance is scheduled to be <br /> heard by the Zoning Board of Appeals at the Public Hearings on December 13, 2000. <br /> No comments were received from abutters. <br />
