Bohnenberger SP-00-194 2 <br /> Board of Appeals <br /> SPECIAL PERMIT CRITERIA <br /> il!�II i. <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> GENERAL FINDINGS j <br /> 1. that the subject property is located at 43 Riverside Road and consists of <br /> 36,200 square feet. <br /> SPECIFIC FINDINGS <br /> I; <br /> The Board determined: <br /> 1. that there is adequate land area to provide sufficient parking. <br /> 2. that the immediate neighborhood consists of single-family homes of similar <br /> size; many of which have been improved with additions or reconstruction. <br /> 3. that installation of a new Title V septic system would be an improvement to <br /> the neighborhood and to the subject property. <br /> 4. that demolition of the old, pre-existing, non-conforming dwelling and <br /> I II I� <br /> construction of a new single-family home would be an improvement to the j <br /> neighborhood and to the subject property. <br /> 5. because of the unusual rectangular shape of the lot, that there is no other <br /> location for the proposed new construction. j <br /> I � <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion ",jWit <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on November <br /> II �i <br /> 22, 2000 to grant a Special Permit.
