Mashpee Zoning Minutes-December 13, 2000 11 <br /> Board of Appeals <br /> t <br /> The Zoning Board of Appeals received a request dated November 8, 2000 from the <br /> Petitioner for an extension of the above-referenced Variance, stating that delays area <br /> result of complications with the subject lot and with the Conservation Commission <br /> At the Public Hearings on December 13, 2000, the Zoning Board of Appeals voted <br /> unanimously to grant the extension for a period of six months. This was allowed in <br /> compliance with Massachusetts General Laws Chapter 40A, Section 10, which reads "If <br /> the rights authorized by a variance are not exercised within one year of the date of grant �I <br /> of such variance such rights shall lapse;provided,however, that the permit granting <br /> authority in its discretion and upon written application by the grantee of such rights may , <br /> extend the time for exercise of such rights for a period not to exceed six months; and <br /> provided, fiuther,that the application for such extension is filed with such permit <br /> granting authority prior to the expiration of such one year period". <br /> Donald B. &Evelyn McIntyre—Request a Variance from Section 174-33 of the Zoning <br /> By-laws for permission to vary the setback requirements from the water and wetlands <br /> to allow for construction of a single-family dwelling with a breezeway and an <br /> attached garage on property located in an R-3 zoning district at 190 Waterway <br /> (Map 111 Block 95) Mashpee, MA. <br /> Sitting: Robert G.Nelson, Richard T. Elizenberry. <br /> At the Public Hearings on December 8, 1999, the Board voted unanimously to grant the <br /> Variance. <br /> The Board received a letter from Cape &Islands Engineering on behalf of the Petitioner <br /> requesting an extension of the above-referenced Variance, V-99-106, citing that delay in <br /> starting the project is due to lack of funding. <br /> At the Public Hearings on December 13, 2000,the Zoning Board of Appeals voted <br /> unanimously to grant the extension for a period of six months.
