Mashpee Zoning Jeffrey P. &Diane C. Keohane SP-01-2 2
Board of Appeals
SPECIAL PERMIT CRITERIA
E
Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General
Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change
shall not be substantially more detrimental to the neighborhood than the existing
non-conforming use. o
GENERAL FINDINGS
i
F'J5 1. that the subject property is located at 6 Cross Tree Way and consists of 25,500
yr.
square feet of land.
SPECIFIC FINDINGS j
The Board determined that:
=; 1. the changes between the proposed construction and the prior one will result in
an increase in lot coverage but it is under the allowed 20%.
2. there is adequate land area to provide sufficient parking.
3. while the proposed construction will increase the non-conforming nature of
the structure, the changes will not result in a structure or use which is more
„} detrimental to the neighborhood than the prior non-conforming structure and
its use.
4. the immediate neighborhood consists of single-family homes of similar size;
many of which have been improved with additions or reconstruction.
t , ° 5. removal of the existing cesspool and replacement with a new de-nitrification
system located further away from the water and wetlands would be an
improvement to the subject property and to the neighborhood.
6. the proposed location of the construction would be further away from the side
setback requirements than the existing dwelling.
In view of the foregoing, the Mashpee Zoning Board of Appeals found that the
Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion
duly made and seconded, the Zoning Board of Appeals voted unanimously on January
10, 2001 to grant a Special Permit to allow for demolition of an existing dwelling and
construction of new home on the subject property. The Special Permit is conditioned
upon compliance with Cape &Islands Engineering plan entitled: "Single Family
Residence,Proposed Sewage Disposal System,Prepared for Jeffrey P. Keohane,House
#6 Cross Tree Way,Mashpee, MA., Plan No.: 111700, Date:Nov. 17, 2000, Revision:
11/22/00, 12/04/00".
i
