Keohane SP-01-2 2 <br /> Board of Appeals <br /> SPECIAL PERMIT CRITERIA <br /> E <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. �o <br /> GENERAL FINDINGS <br /> i <br /> F'J5 1. that the subject property is located at 6 Cross Tree Way and consists of 25,500 <br /> yr. <br /> square feet of land. <br /> SPECIFIC FINDINGS j <br /> The Board determined that: <br /> =; 1. the changes between the proposed construction and the prior one will result in <br /> an increase in lot coverage but it is under the allowed 20%. <br /> 2. there is adequate land area to provide sufficient parking. <br /> 3. while the proposed construction will increase the non-conforming nature of <br /> the structure,the changes will not result in a structure or use which is more <br /> „} detrimental to the neighborhood than the prior non-conforming structure and <br /> its use. <br /> 4. the immediate neighborhood consists of single-family homes of similar size; <br /> many of which have been improved with additions or reconstruction. <br /> t , ° 5. removal of the existing cesspool and replacement with a new de-nitrification <br /> system located further away from the water and wetlands would be an <br /> improvement to the subject property and to the neighborhood. <br /> 6. the proposed location of the construction would be further away from the side <br /> setback requirements than the existing dwelling. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on January <br /> 10, 2001 to grant a Special Permit to allow for demolition of an existing dwelling and <br /> construction of new home on the subject property. The Special Permit is conditioned <br /> upon compliance with Cape &Islands Engineering plan entitled: "Single Family <br /> Residence,Proposed Sewage Disposal System,Prepared for Jeffrey P. Keohane,House <br /> #6 Cross Tree Way,Mashpee, MA., Plan No.: 111700, Date:Nov. 17, 2000, Revision: <br /> 11/22/00, 12/04/00". <br /> i <br />
