Mashpee Zoning Minutes—January 10, 2001 2 <br /> Board of Appeals <br /> Gary W. & Teresa L Pearson—Request a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the front setback requirements to allow for construction <br /> of an attached garage to an existing home on property located in an R-3 zoning district at <br /> 109 Great Pines Drive (Map 94 Block 37)Mashpee, MA. <br /> Sitting: Edward M. Govoni, James E. Regan III and Robert G.Nelson. <br /> r� <br /> Mr. Pearson represented his Petition and stated that he owns a corner lot. The proposal <br /> would be under 20% lot coverage. He submitted a letter from the homeowners' <br /> association with no objection to thero osal. <br /> p p <br /> The ZBA office received a phone call and a fax from Ms. Forziatti, an abutter, expressing <br /> concern with the height of the proposal and thepossibility that the Petitioner would be <br /> s conducting a plumbing business out of his home. The Board asked ifthe proposal would <br /> ibe used for commercial purposes. <br /> x <br /> Mr. Pearson replied that the proposed addition would be used for storage and a workshop <br /> and that the height of the proposal would not exceed the height of the existing dwelling. <br /> No plumbing to the addition is proposed. <br /> � P p <br /> ,f <br /> Mr. Wheeler stated part of the addition could be used as an accessory building to store <br /> certain equipment and top ark a van. No fabrication (manufacturing)would be allowed. <br /> No other comments were received from abutters. <br /> F Mr. Regan moved to <br /> g grant a Variance of 12 feet on the southerly corner of the lot from <br /> the proposal to Shadbush Road, subject to the following: <br /> • criteria 1, 2, 3, 4—lot is on a cul-de-sac, topography, septic system govern the <br /> location of the proposal. <br /> • findings 1. <br /> • per Town of Mashpee Zoning By-laws, that the proposed addition would not <br /> be used to conduct a commercial business. <br /> fi Mr. Govoni seconded. All agreed. <br /> x <br /> aII <br /> Peter Merlino—Requests a Special Permit under Sections 174-17 and 174-20 of <br /> pz <br /> the Zoning By-laws for permission to demolish existing structures and construct a <br /> -` single-family home on property located in an R-3 zoning district at 18 Quaker Run <br /> Road(Map 83 Block 212) Mashpee, MA. Owner of record: Shoestring Bay Trust. <br /> Sitting: Edward M. Govoni, Robert G. Nelson and Zella E. Elizenberry. <br /> a; <br /> Mr. Merlino represented the Petition and stated the house had already been demolished <br /> prior to his purchasing the subject property. He stated that the original Special Permit has <br /> expired and is seeking permission for a new Special Permit in order to obtain a building <br /> permit. The Board granted Mr. Merlino a Modification to the Special Permit, <br /> SP-98-128. <br />
