Mashpee Zoning Minutes—January 10, 2001 3 <br /> Board of Appeals <br /> No comments were received from abutters. <br /> Mr. Nelson moved to grant the Special Permit, subject to same criteria/fmdings in <br /> SP-98-128. Ms. Elizenberry seconded. All agreed. <br /> Cape Harbor Homes Inc —Requests a Variance from Section 174-31 of the Zoning <br /> By-laws forpermission to vary the side setback requirements to allow for construction <br /> of a single-family home onproperty located in an R-3 zoning district at 110 Degrass <br /> Road(Map 103 Block 6A)Mashpee, MA. <br /> Sitting: Edward M. Govoni, Robert G.Nelson and Marshall A. Brem. <br /> Attorney Kevin M. Kirrane represented the Petition and stated that a mistake was made <br /> when the foundation was poured. The building is tilted and encroaches on the side <br /> setback requirements. A Variance of only 1.9 feet is being requested. The long narrow <br /> shape of the lot creates a hardship and dictates placement of the proposal on the subject <br /> property. Attorney Kirrane said that the small nature of the request would not derogate <br /> from the By-laws or create substantial harm or detriment to the neighborhood or to the <br /> public good. <br /> The lot was created sometime in the 1960's. Mr. Govoni stated that the lot predates <br /> Zoning By-laws. <br /> No comments were received from abutters. <br /> Mr. Nelson moved to grant a Variance of 1.9 feet on the northeasterly corner of the <br /> poured foundation to the property line, subject to criteria 1, 2, 3, 4, findings 1, 2, 3, the <br /> �5 <br /> long narrow shape of the lot and the small relief being requested.
