Mashpee Zoning Minutes—January 24, 2001 3 <br /> Board of Appeals <br /> Mr. Govoni moved to grant a Variance of 2.5 feet on the southerly side of the lot, subject <br /> to findings: that the lot predates zoning and the original stakes were moved prior to the <br /> pouring of the foundation. Mr. Regan seconded. All agreed. <br /> Edward M. &Patricia A. Govoni—Request a Variance from Section 174-31 of the 3 <br /> Zoning By-laws for permission to vary the lot coverage requirements and the front and <br /> side setback requirements to allow for construction of a garage on property located in an <br /> R-3 zoning district at 43 James Circle (Map 71 Block 44)Mashpee, MA. <br /> Sitting: Robert G. Nelson, Zella E. Elizenberry and Marshall A. Brem. Messrs. Govoni <br /> and Regan stepped down. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the Petition and stated <br /> that the proposal calls for construction of a small two-car garage on a lot that was created j <br /> in the 1950's and that predates zoning. Mr. Slavinsky said that the leaching pit would be <br /> removed and a newer one would be relocated farther away from the pond. <br /> Mr. Nelson read several letters from abutters in approval of the project. The John's Pond <br /> Estates Association also sent a letter to the Board in approval of the project. Several <br /> revisions were agreed upon by the Petitioner and the homeowner's association. <br /> Mr. Wheeler confirmed that the Building Department maintains a minimum of 30 feet in <br /> the front and 10 feet on the sides to ensure clear access to the property. <br /> Ms. Elizenberry moved to grant the following: <br /> • a Variance of 4.6% from the lot coverage requirements. <br /> • a Variance of 10 feet from the front setback requirements. <br /> • a Variance of 2 feet from the side setback requirements. <br /> Subject to criteria/findings 1, 2. Mr. Brem seconded. All agreed. <br /> CONTINUED HEARINGS <br /> Calico Real Estate—Requests a Special Permit under Section 174-20 of the Zoning <br /> By-laws for permission to demolish an existing cottage and construct a single-family <br /> home on property located in an R-3 zoning district at 81 Nick Trail (Map 117 Block 99) <br /> Mashpee, MA. <br /> Calico Real Estate—Requests a Variance from Sections 174-31 and 174-33 of the <br /> Zoning By-laws for permission to vary the side and rear setback requirements, the lot <br /> coverage requirements and the setback requirements to water and wetlands to allow for <br /> construction of a single-family home on property located in an R-3 zoning district at 81 <br /> Nick Trail (Map 117 Block 99)Mashpee, MA.
