V-01-20 <br /> Board of Appeals 2 <br /> p <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 23 Spoondrift Way and consists of 9,300 <br /> square feet of land. <br /> VARIANCE CRITERIA <br /> i II. <br /> Section 10 of Chapter 40A requires that the permit <br /> p granting authority determine <br /> that there are circumstances relating shape to thetopographywhich affect this lot and <br /> p and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. f <br /> SPECIFIC FINDINGS ! f <br /> The Board determined that: <br /> III, <br /> 1. there are circumstances relating to the sloping topography that affects the <br /> subject lot and not the district in which it is located. <br /> 2. the subject property is located in the flood plan and is impacted by wetlands; <br /> therefore, a literal enforcement of the By-laws would involve hardship to the <br /> Petitioner. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on February 14, <br /> 2001 to grant a Variance of 8 feet from the front setback requirements. The Variance is <br /> conditioned compliance upon co <br /> m <br /> p p with Edward A.
