I <br /> i <br /> Mashpee Zoning CSC Group Nominee Trust 2 <br /> Board of Appeals V-01-22-1 through V-01-22-28 <br /> Ms. Dulce Bryan, an abutter, said that the proposal would be "ruining your l <br /> two-acre zoning" and"crowds your schools and crowds your roads" and that it <br /> "destroys the whole intent of zoning". !!' <br /> Mr. Paul Avrett, an abutter, agreed with Ms. Ryan's comments. He said that I� <br /> there is already a lot of traffic in the area and that constructing 28 more homes in the <br /> area would only add to the congestion. <br /> Ms. Shirley Nurse Peters, an abutter, also objected to the proposal J p sal and said that <br /> p <br /> the Petitioner should have done his homework prior to his Petition and should not now be <br /> asking for relief due to financial hardship because of the Growth Management By-law. <br /> I ; <br /> Mr. Regan suggested to the abutters that they keep in mind that many cluster <br /> subdivisions exist in Town that are significantly more dense that the proposed Lowell <br /> Road subdivision. <br /> Members of the Board expressed a need to peruse the Cape Cod Commission <br /> document and voted unanimous) to continue the Petition until March 28 2001 <br /> Y , <br /> At the continued hearings on March 28, 2001,Mr. Regan announced that this is a <br /> I <br /> Chapter 112 Hearing. I <br /> i ! <br /> Attorney Peter M. Daigle represented the Petition and stated that the 33-acre <br /> ! I <br /> parcel completed an exhaustive one-year review process with the Cape Cod Commission. <br /> Members of the Board confirmed that they had thoroughly examined the Cape <br /> Cod Commission Lowell Road Subdivision DRI Decision document and that the <br /> Decision demands numerous conditions and restrictions on the proposal that would <br /> benefit and protect the Town's interests. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS I <br /> 1. that the subject property is located at the intersection of Lowell Road and <br /> Great Neck Road North and consists of over 33 acres. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> 1 <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the Planning Board, Town Planner, Mashpee Environmental Coalition and the <br /> Water District have approved the proposal. <br />
