• TOWN OF MASHPEE <br />Minutes — Zoning Board of Appeals <br />Wednesday, March 14, 2001 <br />The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, March 14, <br />2001, at 7:30 P.M. at the Mashpee Town Hall. Board Members present were Chairman <br />Edward M. Govoni, and Associate Members Richard T. Guerrera, Zella E. Elizenberry, <br />Frederick R. Borgeson and Marshall A. Brem. Building Commissioner Russell W. <br />Wheeler also attended the meeting. Vice Chairman James E. Regan III and Clerk Robert <br />G. Nelson were not present. <br />PUBLIC HEARINGS <br />Mark & Susana L. Gorstein — Request an Appeal of the Building Commissioner's <br />Decision to issue a building permit to Frederick R. and Lois S. Glass to allow for <br />construction of a single-family home on property located in an R-3 zoning district <br />at 133 Tide Run (Map 120 Block 180) Mashpee, MA. <br />At the request of the attorneys, the Board voted unanimously to continue the Petition <br />until the March 28, 2001 Public Hearings. <br />PAL Trust — Requests a Variance from Section 174-31.4. of the Zoning By-laws for <br />• permission to use the proposed new finish grade elevation combined with the existing <br />grade elevation to allow for construction of a single-family home on property located in <br />an R-3 zoning district at 157 Monomoscoy Road (Map 114 Block 23A) Mashpee, MA. <br />Sitting: Edward M. Govoni, Richard T. Guerrera and Frederick R. Borgeson. <br />Mr. Paul Lalito, owner of LEC Environmental, represented the Petition. Architect Terry <br />Luff and new owner, Ralph A. Cook, also attended the meeting. <br />Because placement of the septic system had to be elevated from the original grade, the ' <br />Petitioner is requesting a height Variance. Mr. Lalito said that a very small portion of the <br />house, approximately 5% of the roofline, exceeds the 35 -foot height restriction. Mr. Luff <br />said that the extra room on the third floor would be a lookout room. He stated that the <br />foundation elevation had to be brought from elevation 6 to elevation 13 in the flood plain. <br />Messrs. Govoni and Borgeson remarked that the proposal is a three-story construction. <br />Mr. Govoni said that in the 15 years he has served on the Board, the Board has only <br />granted a Variance from the height requirements for a commercial building in Mashpee <br />Commons to allow for a parapet. <br />Messrs. Guerrera and Borgeson said that the lookout room is not an essential part of the <br />proposal and does not constitute a hardship for the Petitioner. <br />0 <br />
