Mashpee Zoning Minutes—March 28, 2001 3 <br /> Board of Appeals <br /> On March 21, 2001,the Zoning Board of Appeals received a fax from the Mattress & <br /> Furniture Place requesting Withdrawal Without Prejudice of the above-referenced <br /> Special Permit, SP-01-28. <br /> Mr. Borgeson moved to accept the Request for Withdrawal Without Prejudice of the <br /> Special Permit, SP-01-28. Mr. Guerrera seconded. All agreed. No fees have to be <br /> reimbursed as the Petitioner's check was returned for insufficient funds. The ZBA office <br /> informed the Tax Collector's office to waive the fee in view of the fact that the <br /> Petitioner's request for a Withdrawal of the Petition. <br /> Gary Tavares—Requests a Special Permit under Sections 174-25.G.4, 174-25.G.7, <br /> 174-25.G.9 and 174-25.H.6 of the Zoning By-laws for permission to conduct a landscape <br /> contractor's business with wholesale sales and indoor and outdoor storage of supplies, <br /> equipment and vehicles on property located in I-1 and R-3 zoning districts at 129 <br /> Industrial Drive (Map 88 Block 98) Mashpee, MA. Owner of record: Paul Deruyter, <br /> Trustee. <br /> Sitting: James E. Regan III, Frederick R. Borgeson and Marshall A. Brem. <br /> Attorney Laura Moynihan of Ament and Ament represented the Petitioner and stated that <br /> Mr. Tavares is therinci al of Francisco Tavares, p gan Inc. which is a company engaged in <br /> p p <br /> Y <br /> eng <br /> the landscaping contracting <br /> business in the Towns of Falmouth Bourne and Mashpee. <br /> Mr. Tavares currently operates out of two sites in Falmouth that are much larger than the <br /> proposed site in Mashpee. <br /> Attorney Moynihan stated that the proposal calls for development of a landscaping <br /> contracting business in the Industrial Park. The subject lots are exempt from the Cape <br /> Cod Commission Development Agreement. Total size of the site is more than3/a acres, <br /> has access off Industrial Drive and abuts a residential zone. Plans call for construction in <br /> the front portion of the site of a 4000-square foot, one-story building with storage and <br /> office space. The proposal meets the 75-foot setback requirement from the street. <br /> Parking would be installed on the side and rear of the building. Natural buffers exist in <br /> the front and in the rear of the site. A former gravel pit would be re-vegetated to provide <br /> I <br /> more of a buffer from Great Hay Road. Installation of a security fence is also proposed. <br /> No retail sales are allowed in the I-1 zoning district; therefore, the Petitioner is requesting <br /> permission for wholesale sale and indoor and outside storage of materials and equipment. <br /> Attorney Moynihan stated that the proposed use would be fairly low in intensity as it is <br /> designed for storage of lighter equipment, such as bobcats and pick-up trucks. She <br /> indicated that employees would arrive early in the morning,pick up their materials and <br /> equipment and leave the site for the day. The Falmouth site would house the larger types <br /> of equipment. <br /> Ii <br /> Attorney Moynihan referred to the building plans and stated that the Design Review j <br /> Committee and Technical Review Team have approved the project.
