Mashpee Zoning Minutes—March 28, 2001 9 <br /> Board of Appeals <br /> Mr. Guerrera asked for the figures relating to runoff from the Gorstein's property. <br /> Attorney Roberts said that she could obtain those figures for the Board. <br /> Mr. Borgeson moved to Deny With Prejudice the Request of the Appeal of the Building <br /> Commissioner's Decision to issue a building permit to 133 Tide Run. Mr. Brem <br /> seconded. All agreed. <br /> Frederick R. &Lois S. Glass—Request an Appeal of the Building Commissioner's <br /> Decision to Deny a Building Permit on property located in an R-3 zoning district <br /> at 133 Tide Run (Map 120 Block 180)Mashpee, MA. <br /> Sitting: James E. Regan III, Richard T. Guerrera and Frederick R. Borgeson. <br /> Attorney Kirrane expressed a desire to continue/extend the abov - <br /> referenced Glass <br /> Appeal in order t o preserve protection for his client. He indicated that his client would it <br /> withdraw the Petition as soon as a valid building permit is in hand and construction is <br /> allowed to proceed. Attorney Kirrane expressed essed concern that Withdrawal of the Petition <br /> at this time would jeopardize his client's rights. <br /> Mr. Borgeson moved to continue/extend the Appeal until December 31, 2001. Mr. <br /> Guerrera seconded. All agreed. The Board and Attorney Kirrane signed a mutually <br /> agreed upon continuance/extension date for the Board to render a decision. The <br /> document shall be filed with the Town Clerk. <br /> Mr.Regan expressed annoyance at the nature of the Gorstein Appeal.
