Mashpee Zoning Daniel J. Bohnenberger SP-01-33 2
Board of Appeals
SPECIAL PERMIT CRITERIA
Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General
I
Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change
shall not be substantially more detrimental to the neighborhood than the existing
non-conforming use.
GENERAL FINDINGS'
1. that the subject property is located at 43 Riverside Road and consists of
i II
36,200 square feet.
Ili I
SPECIFIC FINDINGS
I Iil
The Board determined: l
1. that there is adequate land area to provide sufficient parking.
I! I
2. that the immediate neighborhood consists of single-family homes of similar
size;many of which have been improved with additions or reconstruction.
3. that installation of a new Title V septic system would be an improvement to
the neighborhood and to the subject property.
4. that demolition of the old,pre-existing,non-conforming dwelling and
construction of a new single-family home would be an improvement to the
neighborhood and to the subject property.
5. because of the unusual rectangular shape of the lot, that there is no other
location for the proposed new construction.
In view of the foregoing, the Mashpee Zoning Board of Appeals found that the
Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion
duly made and seconded, the Zoning Board of Appeals voted unanimously on March 28,
2001 to grant a Special Permit. The Special Permit is conditioned upon compliance with
Holmes and McGrath, Inc.plans entitled"Plot Plan of Proposed Sewage Disposal System
Prepared for Daniel Bohnenberger for Lot 31, #41 Riverside Road in Mashpee,MA., Job
No.: 200108, Date June 21, 2000, Revision Dates: 8/4/00, 10/24/00 and 3/7/01".
