Mashpee Zoning Michael Scolavino SP-01-35 2 <br /> Board of Appeals <br /> SPECIAL PERMIT CRITERIA <br /> Sections 174-17 and 174-24 of the Mashpee Zoning By-laws and Massachusetts <br /> General Laws Chapter 40A, Chapter 6,require a finding that the extension, alteration or <br /> change shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use,that the proposed use is consistent with applicable state and town <br /> regulations, statutes, bylaws and plans and will not adversely affect public health and <br /> safety. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the proposal is permitted with grant of a Special Permit by the Board. ! <br /> 2. the existing cottage does not conform to the flood hazard requirements;the j <br /> new construction will conform to the flood hazard requirements. <br /> I <br /> 3. the proposed construction will conform to the setback requirements. <br /> 4. there is adequate land area to provide sufficient parking. <br /> I <br /> 5. while the proposed construction will increase the non-conforming nature of <br /> I <br /> the structure,the changes will not result in a structure or use which is more <br /> detrimental to the neighborhood than the prior non-conforming structure and <br /> its use. <br /> 6. the immediate neighborhood consists of single-family homes of similar size; <br /> many of which have been improved with additions or reconstruction. ! <br /> 7. the proposal would be an improvement to the subject property and to the <br /> neighborhood. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on April 23, <br /> 2001 to grant a Special Permit. The Special Permit is conditioned upon compliance with <br /> the following: <br /> 1. Cape & Islands Engineering plans entitled"Proposed Site Plan Located in <br /> Mashpee, Mass., Prepared for Michael Scolavino,House No. 79 Seconsett <br /> �I <br /> Island Road, Date: Mar.5, 2001 <br /> 2. Yarosh Associates, Inc.plan entitled"Scolavino Residence,Date: 11-00". <br />
