TOWN OF MASHPEE <br /> Minutes—Zoning Board of Appeals <br /> Wednesday, April 25, 2001 <br /> i . <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, <br /> April 25, 2001, at 7:30 P.M. at the Mashpee Town Hall. Board Members present <br /> were Vice Chairman James E. Regan III, Clerk Robert G. Nelson and Associate j <br /> Members Richard T. Guerrera, Zella E. Elizenberry, Frederick R. Borgeson and <br /> Marshall A. Brem. Chairman Edward M. Govoni was not present. <br /> CONTINUED HEARINGS <br /> First Student, Inc. —Requests a Special Permit under Section 174-25.G.7 of the Zoning <br /> By-laws for permission to park school buses on properties located in a C-2 zoning district <br /> at 10 and 16 Echo Road(Map 20 Blocks 25 and 26)Mashpee, MA. Owner of record of <br /> 10 Echo Road: Echo Road Realty Trust. Owner of record of 16 Echo Road: Eagle Realty <br /> Trust. <br /> I <br /> This Petition has been continued to allow the Building Commissioner an opportunity to <br /> receive Town counsel opinion on whether or not use is allowed in this zoning district. <br /> Mr. Brem suggested that Petitioner should have other alternatives if the proposed use is <br /> not allowed on the subject property. Mr. Regan asked if the Petitioner has looked into <br /> revising the contract so that the school buses can be parked in another Town. Mr. <br /> Quinlan of First Student, Inc. replied that Echo Road seems to be his only alternative at <br /> this time. He indicated that the contract revision would have to be brought up with the <br /> School Committee. Mr. Quinlan said that the committee is aware of the problem and has <br /> asked him to exhaust all other options before considering a revision of the contract. <br /> Mr.Nelson questioned if the Town receives excise tax from the school buses. Mr. <br /> Quinlan replied that Mashpee would receive excise tax even if the buses were not parked <br /> in Mashpee. He indicated that the excise tax is approximately$85 for each of the 17 <br /> buses. <br /> Mr. Regan questioned which students First Student, Inc. would transport. Mr. Quinlan <br /> replied that First Student would transport all students except for the students transported <br /> by Town-owned special needs vehicles. <br /> Mr. Brem stated that "Laidlaw is your competition". Mr. Regan asked if Laidlaw has a <br /> contract with Mashpee. Mr. Nelson said that Laidlaw is parking its Sandwich buses in <br /> Mashpee on Echo Road and that he has a problem with that. Mr.Nelson suggested that <br /> the Board look at the original Special Permit granted to Laidlaw and see if the decision <br /> contains any special conditions. <br /> The Board voted unanimously to continue the Petition until May 9, 2001. <br /> i i j' <br />
